Terms of Service

These Terms of Service regulate your use of the Android Exploits application and our associated products and services (collectively referred to as the "Service"), as well as any content, such as information, text, graphics, URLs, files, audio, video, photos, or other materials uploaded, downloaded, or visible within the Service ("Samples"). In these terms, "you" or "your" refer to you as a user of our Service, while "we," "us," "our," or "Android Exploits" pertain to SarotecK, the company that owns and operates the Android Exploits app. Please note that both Android Exploits and SarotecK are subsidiaries of SarotecK.

Whether you're a member of the general public, a security partner, or part of our security-conscious community ("Community") using the Service to contribute and utilize Samples, your usage of any part of the Service implies your acceptance of these Terms of Service. This includes provisions that limit our liability and impact your legal rights. You are also subject to any referenced and incorporated guidelines and policies, such as our Sample & Community Content Guidelines (which detail the safe sharing of Samples through the Service) and the terms found in our Privacy Policy (explaining how we collect, use, and share the personal information you provide). Additionally, any specific terms related to your particular use of the Service become an integral part of your agreement with us.

If you are using the Service on behalf of a business, you affirm that you possess the authority to bind that business or entity to these Terms, and the business, in turn, acknowledges and accepts these Terms.

Usage Limitations for Android Exploits

By using Android Exploits, you commit to not engage in or attempt the following:

  1. Employing the service in a manner that violates any relevant local, national, or international laws or regulations.
  2. Utilizing the service in a way that might infringe upon the rights or interests of Android Exploits, the Community, or any third party. This includes activities aimed at substantiating or refuting a concept, discrediting, or provoking entities in the anti-malware sector.
  3. Copying, altering, modifying, creating derivative works, publicly displaying, republishing, uploading, posting, transmitting, reselling, or distributing any material, information, or functionalities from the service. This encompasses actions like using the service for antivirus/URL scanner testing or any acts that could directly or indirectly harm, compete with, or obstruct the antivirus industry/URL scanner industry.
  4. Transferring any rights granted to you under these terms.
  5. Employing the service for unlawful activities or outputs, or in a manner that puts Android Exploits, yourself, members of the Community, or our Partners in harm's way.
  6. Engaging in any activities that could disrupt, overload, damage, or hinder the regular functioning of the service.
  7. Acquiring or using any Samples unless explicitly permitted by the service, or attempting to use the service to collect information that might identify individual persons in their private capacity. This includes trying to access or misuse content found in any Sample. The service and Samples should only be used for non-commercial purposes, specifically for detecting and preventing malware.
  8. Publicly attributing the knowledge you gain through the service to any Android Exploits Partner (antivirus vendors, URL scanning engines, file characterization tools, etc.) without the express permission of each Partner.
  9. Attempting unauthorized access to our Site, the server hosting our Site, or any server, computer, or database linked to our Site.
  10. Launching an attack or attempting to attack our Site through denial-of-service or distributed denial-of-service attacks.
  11. Submitting Samples that fall under the International Traffic in Arms Regulations ("ITAR") maintained by the U.S. Department of State or taking any action that would necessitate SarotecK to provide a defense service as defined by ITAR, or using the service in any manner other than as explicitly permitted under these terms.

Guidelines for Samples and Community Content

When contributing any Sample, along with relevant hardware and device information, to the Android Exploits Community, you confirm that all content within the Sample complies with our Terms and Privacy Policy. You assert that you either own the Sample, hardware, and device information you submit, or have the necessary rights and permissions to permanently contribute this data and share it within the Community.

Upon submitting a Sample, you acknowledge that it, including the hardware and device information, is promptly shared for review by the Service’s Partners. The ensuing intelligence report, enriched with this data, is shared with you and the Partners, who use it to enhance their own systems. Your contribution plays an active role in advancing global IT security standards.

While you maintain ownership rights in the original content within the Sample, including hardware and device information, when you upload or submit a copy of the Sample, you grant Android Exploits (along with its affiliates) a worldwide, royalty-free, irrevocable, and transferable license to utilize, modify, host, store, reproduce, create derivative works, communicate, publish, publicly perform, publicly display, and distribute all content within the Sample.

YOU ALSO AGREE THAT YOU WILL ONLY UPLOAD SAMPLES, INCLUDING HARDWARE AND DEVICE INFORMATION, INTENDED FOR PUBLIC SHARING. UNDER NO CIRCUMSTANCES WILL YOU KNOWINGLY SUBMIT ANY SAMPLE CONTAINING CONFIDENTIAL, COMMERCIALLY SENSITIVE, OR PERSONAL DATA OF ANY INDIVIDUAL WITHOUT LEGAL PERMISSION.

While we are not obligated to continuously monitor Service usage, user content, Samples, or hardware and device information, we may conduct monitoring to detect and prevent fraudulent activities or violations of these Terms. We reserve the discretion to remove Samples, content, or users from the Service at any time and for any reason without prior notice. However, for the sake of promoting Community security and ensuring transparency in information sharing, accounts and Samples, including hardware and device information, contributed by the Community (e.g., comments, posts, etc.) will generally not be removed from the Service unless they are illegal, infringe on an individual's lawful rights, serve any unethical or malicious purpose, or otherwise breach these Terms.

IF YOU DO NOT WISH TO SHARE A SAMPLE, INCLUDING HARDWARE AND DEVICE INFORMATION, PUBLICLY AS DESCRIBED IN THESE TERMS OR THE PRIVACY POLICY, PLEASE DO NOT SEND OR CONTRIBUTE IT TO THE SERVICE. THE SERVICE OPERATES ON THE PRINCIPLE OF COLLECTIVE AGGREGATION AND SHARING OF THREAT-INTELLIGENCE WITH AND THROUGH THE COMMUNITY.

If you believe someone is infringing your copyright, you can report it to us at dmca-agent@google.com, and we will take appropriate action. Android Exploits' policies permit the termination, in appropriate cases, of access to the Service for repeat infringers.

Android Exploits Rights

All rights, titles, and interests in the Android Exploits Service (excluding third-party brand names) are and will remain the exclusive property of Android Exploits and its licensors. These Terms should not be interpreted as granting, either implicitly or otherwise, any license or right under any copyright, patent, trademark, database right, sui generis right, or other intellectual property or proprietary interest of Android Exploits, its licensors, or any third party. We reserve the right to remove any Samples at our sole discretion and without prior notice. These Terms do not confer upon you the right to use Android Exploits' trademarks, logos, domain names, or other distinctive brand features.

Any Samples, feedback, comments, or suggestions that you provide regarding Android Exploits or the Service are entirely voluntary. We are free to use any feedback, comments, or suggestions as we see fit, without any obligation to you, and we reserve the right to remove any Sample at our sole discretion and without prior notice.

Changes in Service

The Service provided by Android Exploits is continually evolving, and the form and nature of the Service we provide may change from time to time without prior notice to you. Any changes to the Service, including the introduction of new features, are subject to the then-current Terms. Furthermore, Android Exploits may, at its discretion, discontinue the provision of the Service (either permanently or temporarily) without prior notice. We also retain the right to impose limits on your use of the Service, including storage, at our sole discretion, without prior notice to you.

Disclaimers

Your use of the Android Exploits Service is entirely at your own risk. You understand and agree that the Service is provided to you on an "AS IS" BASIS WITHOUT ANY REPRESENTATION OR WARRANTY, whether expressed, implied, or statutory. WITHOUT LIMITING THE ABOVE, ANDROID EXPLOITS SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT OR GUARANTEE THAT THE SERVICES ARE ACCURATE, RELIABLE, OR ERROR-FREE; THAT THEY WILL MEET YOUR SPECIFIC REQUIREMENTS; THAT THE SERVICES WILL BE AVAILABLE AT ALL TIMES, UNINTERRUPTED, SECURE, OR FREE FROM DEFECTS; OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We shall not be held liable for any loss or damage resulting from distributed denial-of-service attacks, viruses, or other technologically harmful materials that may infect your computer equipment, software, data, or other proprietary materials due to your access to or use of the Service, or any third-party content or websites accessed through or in conjunction with the Service.

Our Service may include links to third-party websites or resources that may contain user comments and non-anchored linked URLs. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services available from such websites or resources. The presence of such links does not constitute an endorsement by Android Exploits of the websites, resources, or the content, products, or services offered there. You assume full responsibility for and accept all risks associated with your use of any such websites or resources. You also acknowledge that user comments on URLs and Samples in the Service may include links to potentially harmful content. ANDROID EXPLOITS MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING SUCH THIRD-PARTY WEBSITES, PRODUCTS, OR CONTENT, AND EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE.

Except as may be required by law and as outlined in our Privacy Policy, you further understand and agree that Android Exploits is not responsible or liable for the deletion of, or the failure to store or transmit, any Sample, Content, other materials, or communications maintained by the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANDROID EXPLOITS, ALONG WITH ITS PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS, SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. This includes, without limitation, loss of profits, data, use, goodwill, or other losses that may result from:

  1. Your access to or use of, or inability to access or use the Services.
  2. Any conduct or content of any third party, including, but not limited to, any defamatory, offensive, or illegal conduct by other users or third parties.
  3. Any content obtained from the Services.
  4. Unauthorized access, use, or alteration of your transmissions, Samples, or content.

These exclusions apply regardless of whether the basis for alleged liability is contract, tort, negligence, strict liability, or any other legal theory. This limitation of liability extends to cases where Android Exploits has or hasn't been informed of the potential for such damage.

THIS LIMITATION OF LIABILITY SECTION APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

About These Terms

It's important to note that we may periodically update and modify these Terms. Any such changes will be posted on the Site. By continuing to use the Service after these changes take effect, you agree to be bound by the updated Terms.

The fact that Android Exploits chooses not to enforce a specific right or provision within these Terms does not indicate a waiver of that right or provision. Should any part of these Terms be considered invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, and any disputes or claims arising from them, their subject matter, or formation (including non-contractual disputes or claims), will be governed by and interpreted in accordance with the laws of Ireland. The Irish courts will have exclusive jurisdiction over any claims related to the Service. However, we retain the right to pursue legal action against you for any violations of the Terms in your country of residence or any other relevant country.
